Welcome to My Little Necklace.

These Terms of Service (“Terms”) apply when you access au.mylittlenecklace.com (the “Site”) or purchase products from us.

By using the Site or placing an order, you agree to these Terms. Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products to you.

2. Using Our Website

You may only use the Site for lawful purposes.

You must not:

• use the Site in violation of applicable laws;

• attempt to interfere with the operation or security of the Site;

• introduce viruses, malicious code or other harmful technology;

• collect or misuse information about other users;

• use the Site for fraudulent purposes; or

• infringe our intellectual property rights or those of another person.

We may restrict or suspend access to the Site where we reasonably believe these Terms have been breached or the Site is being used unlawfully or fraudulently.

3. Products & Personalisation

My Little Necklace specialises in personalised and made-to-order jewellery.

We make reasonable efforts to display our products, colours, dimensions and finishes accurately. However, the appearance of colours may vary slightly depending on your screen or device.

Because many of our products are individually made, minor variations in appearance may occur. These variations do not affect your rights under the Australian Consumer Law.

Personalisation details

You are responsible for checking the personalisation information you submit before placing your order, including names, spelling, initials, dates, sizes, fonts and other selected options.

We manufacture personalised products using the information submitted with your order.

If you submit incorrect personalisation information and we manufacture the product according to that information, this will generally not constitute a fault with the product.

If we make an error and the item does not correspond with the personalisation information you submitted, please contact us at support@mylittlenecklace.com.

4. Orders

By placing an order, you are offering to purchase the selected products at the price and on the terms displayed at checkout.

After placing an order, you will normally receive an order confirmation by email.

We reserve the right to reject or cancel an order where reasonably necessary, including where:

• a product is unavailable;

• there is an obvious pricing or product information error;

• payment cannot be authorised;

• we reasonably suspect fraud or unauthorised activity;

• an order contains personalisation that we cannot reasonably manufacture; or

• fulfilling the order would breach applicable law.

If we cancel an order after payment has been taken and no product has been supplied, we will refund the amount paid for the cancelled item or order.

5. Changes & Cancellations of Personalised Orders

We begin processing personalised orders as quickly as possible.

If you notice an error after placing your order, contact us immediately at support@mylittlenecklace.com.

We will try to accommodate changes or cancellations where possible, but we cannot guarantee that an order can be changed or cancelled once production has begun.

This does not affect any rights you may have under the Australian Consumer Law.

6. Prices & Payment

Prices displayed on the Australian Site are in Australian dollars (AUD) unless otherwise stated.

Any applicable taxes and shipping charges will be displayed at checkout where applicable.

We may change product prices at any time, but a price change will not affect an order that we have already accepted, except where there is an obvious pricing error.

Available payment methods are displayed at checkout.

7. Promotions & Discount Codes

Promotions, discount codes and special offers may be subject to additional conditions displayed with the relevant offer.

Unless otherwise stated:

• discount codes cannot be exchanged for cash;

• only one discount code may be used per order;

• promotions cannot be applied retrospectively to completed orders; and

• promotions may have an expiry date or apply only to selected products.

Nothing in this section affects your rights under the Australian Consumer Law.

8. Shipping & Delivery

Shipping options, estimated delivery times and applicable charges are displayed on the Site or during checkout.

Delivery estimates are estimates only and may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, weather events and peak periods.

You are responsible for providing an accurate and complete delivery address.

If you notice an error in your delivery information, please contact support@mylittlenecklace.com as soon as possible.

Nothing in this section limits any rights you may have under the Australian Consumer Law in relation to delivery of your order.

9. Returns, Refunds & Consumer Guarantees

Our Returns & Refund Policy forms part of these Terms.

Because personalised and made-to-order products are created specifically for you, we do not generally accept returns or exchanges simply because you change your mind.

However, this does not limit your rights under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Among other things, goods must be:

• of acceptable quality;

• fit for any disclosed purpose;

• consistent with their description; and

• consistent with any applicable express warranties.

If a product fails to comply with an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and the requirements of the Australian Consumer Law.

10. Intellectual Property

Unless otherwise indicated, the content of the Site, including our branding, product designs, photographs, graphics, text, logos and other content, is owned by or licensed to My Little Necklace and is protected by applicable intellectual property laws.

You may use the Site for your personal, non-commercial use.

You may not reproduce, distribute, modify, sell or commercially exploit our Site content without our prior written permission, except where permitted by law.

11. Reviews & Content You Submit

If you submit a review, photograph, comment or other content to us or through the Site, you confirm that you have the right to submit that content and that it does not violate applicable law or another person's rights.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display content you voluntarily submit to us in connection with operating, promoting and improving My Little Necklace, subject to applicable law.

We may remove content from the Site where we reasonably consider it unlawful, misleading, offensive, infringing or otherwise inappropriate.

12. Third-Party Services & Links

The Site may use or link to services provided by third parties, including payment providers, shipping providers, social media platforms and other technology providers.

Your use of third-party websites or services may also be subject to their own terms and privacy policies.

We are not responsible for third-party websites that we do not operate or control.

14. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth).

Nothing in these Terms is intended to exclude, restrict or modify:

• any consumer guarantee under the Australian Consumer Law;

• any right or remedy available to a consumer under the Australian Consumer Law; or

• any other right or remedy that cannot lawfully be excluded.

To the extent that any provision of these Terms is inconsistent with a right that cannot lawfully be excluded, that provision will apply only to the extent permitted by law.

15. Liability

To the maximum extent permitted by law, we are not responsible for losses resulting from:

• misuse of our products;

• failure to follow reasonable product care instructions;

• incorrect information supplied by you, including personalisation or delivery information; or

• events outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies our liability where doing so would be unlawful, including liability arising under the Australian Consumer Law.

16. Changes to the Site or These Terms

We may update these Terms from time to time, including to reflect changes to our products, services, business practices or legal obligations.

The Terms applicable to your purchase are those in effect when your order is placed, unless a change is required by law.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary, without affecting the validity of the remaining provisions.

18. Governing Law

These Terms are governed by the laws applicable in Australia.

Nothing in this section limits any rights you may have under applicable Australian consumer protection laws.
